TN Legal Services offers a variety of notary and commissioner of oaths services.

Notary Public and Commissioner of Oaths Service

Notary Services by a Notary Public – an accredited person appointed by a Provincial Government. Their primary role is to serve as a witness to signed documents. The signatures must be accomplished in person. The Notary Public will attest that they witnessed the signature by signing the document and affixing their seal.

Affidavits

An affidavit is a document containing statements (or a statement) that you, the deponent, swears to be the truth, accurate and to the best of your knowledge. An affidavit is a document containing information that is verified by the swearing of an oath or by an affirmation. Evidence in Family Court is usually submitted through an affidavit.

After you swear to the truth of the statement or statements, we will witness and confirm that the oath or affirmation was administered correctly and ensure that you signed the document after taking the oath.

Commissioner of Oaths

Commissioners of Oaths are accredited individuals provincially empowered to administer and witness the swearing of oaths or solemn affirmations in the taking of affidavits. So it can be concerning any legal matter.

They can also witness declarations as required under any statute or law in Ontario. The person that is swearing an oath, making a declaration or an affirmation is called a deponent or declarant.

A commissioner of oaths only certifies that the required oath, affirmation or declaration has been properly administered to the best of his or her knowledge, rather than certifying the truth of the statements contained in a document or a set of documents, which remains the responsibility of you as the declarant or deponent.

In Ontario, a Commissioner of Oaths must administer the oath or while the deponent is physically present before the Commissioner of Oaths. The Commissioner of Oaths must also be satisfied with the authenticity of the identity, the signature of the deponent or declarant before affixing his seal, stamp and signature. The signature can usually be confirmed by comparing it to a piece of identification, such as a driver’s licence or a provincial health insurance card.
